1. About these terms
These terms are an agreement between you and Micah Brook, a sole trader, trading as realfly.ai ("realfly", "we", "us"). They apply when you visit realfly.ai, create an account, buy a plan or use any realfly video or share page.
realfly is a business tool. By using it you confirm you're at least 18 and are using it for your business, or for a business you're authorised to act for. Our Privacy Policy and Refund Policy form part of these terms.
Nothing in these terms limits rights you have under laws that can't be excluded, including the Australian Consumer Law. Where these terms say "we're not responsible" or "sales are final", they apply only as far as the law allows.
2. The service
realfly turns real-estate listing photos, and the listing's floor plan where you have one, into AI-animated flythrough videos. You review each video, can re-run parts of it, and approve it before it's delivered. Approved videos are delivered as downloads (including an unbranded cut for listing services that ban branding) and on a white-label share page.
realfly is built so the camera moves and the house stays as photographed: nothing is meant to be added to or removed from the property. Every video is checked against your photos before you see it. Because these are AI videos, the checks can miss things, which is why you must review and approve every video yourself (section 13).
We may change, improve or remove features over time. Features marked "coming soon" on our site aren't part of the service until they're released.
3. Accounts
- You sign in with a link sent to your email. Keep access to that inbox secure; anyone who can open it can sign in to your account.
- Give us accurate details, and keep your email and billing details up to date.
- One account is for one business. Don't share or sell access to your account. You can use it to make videos for as many clients as your plan allows.
- You're responsible for what happens in your account.
- Where realfly is available: realfly isn't available in Cuba, Iran, North Korea, Russia or Belarus, or in the occupied regions of Ukraine (Crimea, Sevastopol, Donetsk, Luhansk, Kherson and Zaporizhzhia), and this list may include other sanctioned regions. You can't use realfly if you're located or ordinarily resident there, or if you're named on a sanctions list. We check the country of sign-ups and payments, may screen against sanctions lists, and may refuse, cancel or close an account (and refund any prepaid fees) where sanctions law requires it.
4. Plans, credits and top-ups
Plans
realfly is sold as monthly or annual subscriptions. Current plans and prices are on our pricing page. Prices are set separately in US dollars and Australian dollars (not converted at live rates) and exclude tax. Where sales tax, VAT or GST applies, Stripe Tax works it out from your billing address and adds it at checkout and on your invoices. Business customers can enter a tax ID at checkout. Annual plans cost 10 times the monthly price, so 12 months for the price of 10.
Credits
- Each plan gives you a number of credits. 1 credit makes one video of about 30 seconds; a video of about 60 seconds uses 2 credits.
- Monthly plans add their credits on each paid monthly invoice. Annual plans add the whole year's credits (12 months' worth) when the annual payment goes through.
- A credit is reserved when you start a video and is only used when the video is delivered. If a video fails, its reserved credit is released (section 7).
- Rollover: unused credits roll over month to month while your subscription is active, for up to 12 months from the date they were issued. The oldest credits are used first.
- When a subscription ends, any remaining plan and top-up credits end with it and can't be refunded or transferred. Subscriptions can't be paused.
- Credits have no cash value and can't be sold or transferred to another account.
Top-ups
On any active plan you can buy extra credits for US$15 (A$23) each, choosing how many at checkout. Top-up credits follow the same rollover and cancellation rules as plan credits.
Payment
Payments are processed by Stripe. By subscribing you authorise us, through Stripe, to charge your payment method for each billing period until you cancel. If a payment fails, Stripe may retry it, and we may limit your account until it's paid. We'll give you at least 30 days' notice of a price change to an existing subscription; it applies from your next billing period after that, and you can cancel before it does.
If you buy a plan, the trial or top-ups through a checkout link on our website before you have an account, sign in to the app with the same email you used at checkout, and the purchase is added to your account.
5. The $1 Pro trial
In short: US$1 today (A$2 in Australia), then US$149/month (A$229) from day 7. Cancel or switch plans anytime before then.
- What you get: 7 days of the Pro plan, with 1 credit (one 30-second video with no watermark) and Pro features.
- What you pay today: a one-off trial fee of US$1, or A$2 if you're billed in Australian dollars.
- Automatic renewal: when you start the trial you're starting a Pro subscription. On day 7 it automatically becomes Pro at US$149 a month (A$229), charged to the card you gave at checkout, and renews every month after that until you cancel, unless you cancel or switch to another plan before the trial ends.
- Reminder: we email you 3 days before the trial ends, with the date you'll be charged, the amount, and one-click links to cancel or switch plans.
- Cancelling: you can cancel the trial or switch plans from Billing in the app at any time, in one click. If you cancel during the trial, you won't be charged anything more.
- Your trial credit is yours to keep if you cancel or switch plans.
- One trial per person: one per account and one per payment card. If a trial breaks this rule, we cancel it straight away and refund the trial fee, and no credit is given.
6. Renewal and cancelling
Every subscription renews automatically at the end of each billing period (monthly or annual) at the then-current price, until you cancel. You can cancel or change plan at any time from Billing in the app. Cancelling is as easy as signing up.
When you cancel, your plan stays active until the end of the period you've already paid for, and isn't renewed after that. We don't give partial refunds for the rest of a period, except where the law requires it. If you switch plans, the change and any proration are shown before you confirm.
7. Refunds
Credit back for videos that fail. If a video still can't pass our accuracy checks after its automatic re-generations and your free re-runs, it isn't delivered and its credit goes back to your balance automatically. You're never charged a credit for a video we couldn't deliver.
Otherwise sales are final. Subscription fees, top-ups and the trial fee aren't refundable once paid, apart from billing errors such as duplicate charges, which we'll refund. This doesn't affect your rights under the Australian Consumer Law or other consumer laws that can't be excluded. The Refund Policy has the detail.
8. Your photos and your rights to them
You may only upload photos, floor plans and other material that you own or are licensed to use for this purpose, including to make AI-animated video from them and to publish that video. You confirm this for each project, and we record that confirmation.
- Many listing photographers license photos for a listing only. Check that the licence covers derivative video, or get the photographer's or the agent's written permission.
- If people can be identified in a photo, make sure you have their permission, or leave that photo out.
- You're responsible for any claim that your material infringed someone's rights.
9. AI disclosure
Every realfly video carries an on-screen AI disclosure by default, saying it was AI-animated from real listing photos and that the camera movement is simulated.
- You can switch the label off for a project's branded videos. To do that you must confirm that you accept responsibility for meeting the disclosure rules that apply to that listing. We record who switched it off, when, from where and the statement you accepted.
- The label is locked on, and can't be switched off, on the unbranded listing-service (MLS) cut, and for properties whose address is in Singapore, Japan, the Netherlands, Belgium or anywhere in the EU/EEA.
- For California and Wisconsin listings, we show a stronger warning and ask you to confirm a second time.
- The setting locks once the final render starts.
- Each video file also carries a machine-readable C2PA Content Credentials manifest that marks it as AI-generated.
Disclosure rules differ by country, state, listing service and portal. You, and the listing agent you make the video for, are responsible for making sure each published video complies, including any requirement to show the original photos (for example, California's AB 723). We don't give legal advice.
10. Acceptable use
You must not use realfly to:
- Use scraped or stolen listing photos, including photos copied from Zillow, Realtor.com, realestate.com.au, Domain or any other site without permission.
- Mislead anyone about a property: for example, presenting an AI video as real drone or camera footage, or editing or describing a video so it shows features the property doesn't have or hides ones it does.
- Break real-estate advertising, consumer protection, fair housing or anti-discrimination laws, including describing who a property is "for" in a discriminatory way.
- Upload anything unlawful, harmful, or that you don't have the right to share, or images of people without their consent.
- Interfere with the service: probing or breaking security, overloading it, scraping it, reverse engineering it, or getting around credit, trial or usage limits.
- Sell, rent or sublicense access to the realfly app itself (the videos you make are yours to use commercially: section 11).
We may remove material, refuse to process a project or suspend an account that breaks these rules (section 16).
11. Branding and commercial use
- You may use the videos you make with realfly commercially, including for other people, under your own brand. realfly isn't a party to any agreement between you and anyone you make videos for.
- No plan puts realfly marks on your videos or on the share pages you send. Share pages carry your branding. On Pro and Agency your logo can appear on the video. Every plan also includes an unbranded, MLS-safe cut.
- Don't say or imply that realfly endorses you, or that you made the videos with a drone or camera.
- If you make videos for someone else, you're responsible to them for what you promise, including quality, turnaround, price and compliance. Pass on the AI disclosure and any original-photo requirements to them.
- Share pages are hosted by us. Anyone with a share-page link can view it, so only send it to people who should see it.
- You give us permission to use the brand material you upload (logo, colours, contact details) to brand your videos and share pages.
12. Intellectual property and licences
- Your material stays yours. You keep all rights to your photos, floor plans and brand material. You give us a non-exclusive licence to store, copy, process and display them, and to send them to the service providers listed in our Privacy Policy, only as needed to run realfly for you. The licence ends when the material is deleted.
- Your videos. As between you and us, you own the videos you make, subject to the rights in the photos they were made from. Some countries may not grant copyright in AI-generated material, so we can't promise you exclusive rights against third parties.
- We don't use your photos or videos in our marketing without your permission, and we don't sell them.
- realfly's software, site, brand and the marketing kit are ours. We give you a personal, non-transferable licence to use them while your subscription is active. You may use kit scripts and templates in your own outreach, but not sell, share or republish the kit itself.
- If you send us feedback or ideas, we can use them without owing you anything.
13. AI output and no guarantees
realfly uses third-party AI models. AI output can contain errors, including warped lines, changed details or things that weren't in the photos. Our checks are designed to catch these, but they can't catch everything. You must review every video and only approve it if it fairly represents the property. Once you approve and deliver a video, using it is your decision.
We don't promise that the service will be uninterrupted or error-free, or that any video will meet a particular listing service's rules.
No earnings promise. realfly doesn't promise any income from using the service or from the creators program. What you earn depends on your own work, prices and costs.
14. Liability
To the extent the law allows:
- We're not liable for indirect or consequential loss, or for lost profits, revenue, clients or data.
- Our total liability to you for all claims about the service is limited to the amount you paid us in the 12 months before the claim.
- Where the Australian Consumer Law or a similar law applies and lets us limit our liability for a failure to meet a guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
These limits don't apply to liability that can't be limited by law, such as for fraud.
15. Indemnity
You agree to cover our reasonable losses and costs from a third-party claim caused by material you uploaded without the rights to it, by a video you published without a disclosure the law required, or by your breach of section 10.
16. Suspension and termination
- You can stop using realfly and cancel at any time (section 6). You can also ask us to delete your account.
- We may suspend or close an account that seriously or repeatedly breaks these terms, that is used for fraud, or where the law requires it. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.
- If we close your account without a breach on your part, we'll refund any prepaid fees for the unused part of your billing period.
- When an account closes, its credits end, and its share pages and stored material are deleted as described in our Privacy Policy. Download anything you want to keep first.
- We may stop offering realfly altogether with at least 30 days' notice and a pro-rata refund of prepaid fees.
17. Creators program
The creators program runs as a campaign on Content Rewards, and that campaign's listing sets its rates, caps, review rules and payout schedule. Content Rewards pays creators and charges its own fees. Creator perks such as free credits and referral commission are described on the creators page and follow these terms when used in the app.
18. Changes to these terms
We may update these terms. For a change that materially affects you, we'll email you at least 30 days before it takes effect. If you don't agree, you can cancel before then. The date at the top shows the latest version.
19. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts there have non-exclusive jurisdiction. If you're a consumer, you also keep any protections of the law where you live that can't be excluded by agreement.
If part of these terms turns out to be unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
20. Contact
Questions about these terms: team@realfly.ai or the contact form.
